I am writing today regarding Trump’s reckless, dangerous, and illegal use of US military personnel to take action against civilians in Los Angeles, California.
The American people have a right of free assembly under the First Amendment of the US Constitution, and should be able to exercise this right without fearing for their safety, the safety of others at the assembly, and the safety of other persons in the general area in which they are gathered.
Trump’s orders to bring in the National Guard and the U.S. Marines is a direct violation of this right.
Additionally, 18 USC § 1385. “Use of Army, Navy, Marine Corps, Air Force, and Space Force as posse comitatus” provides:
“Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army, the Navy, the Marine Corps, the Air Force, or the Space Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.”
Trump has invoked the use of the USMC in clear violation of this section.
Trump continues to ignore the rule of law, to overstep his powers, and to engage in reckless and irresponsible speech and behaviors which damage our country every hour of the day.
Congress must take immediate action to rein in his illegal and unconstitutional acts, including a demand that the ICE enforcements backed by the USMC in violation of the law cease immediately.
