Gov Polis: Protect Your Constituents - No Cooperation With ICE

I’m outraged that your administration is blatantly betraying Colorado’s immigrant communities by continuing cooperation with ICE in direct violation of multiple state laws you signed into effect. House Bill 19-1124, enacted in 2019, unequivocally prohibits law enforcement from detaining individuals based solely on civil immigration detainers and bars state or probation officers from sharing personal information with federal immigration authorities—unless in a criminal investigation or through a court order . Senate Bill 21-131, signed in 2021, goes further—explicitly forbidding state employees from even seeking out a person’s immigration status or sharing that information with ICE, except under a judicial warrant or subpoena . And in May 2025, you signed Senate Bill 25-276, which expands these protections. It bars local and state officials from sharing personal identifying data with federal immigration authorities except in criminal matters, and restricts ICE agents from entering schools, child care centers, public hospitals, or libraries without judicial authorization . By permitting, encouraging, or directing state employees to share protected information with ICE in non-criminal contexts—or worse, to comply with vague or overly broad subpoenas—you are clearly violating these statutes. This is not leadership—it is illegal and immoral. Let me be clear: Colorado must be a sanctuary, not a pipeline to deportation. Any continued sharing of sensitive data with ICE damages trust, fractures immigrant families, and sends a chilling warning to your own constituents: the law doesn’t matter. I demand that you immediately prohibit all state employees across all departments from further cooperation with ICE unless it falls squarely within the narrow criminal exception established by these laws. This is not only a legal imperative—it’s a political one. Continuing to flout your own laws will cost you the trust and support of immigrant communities, allies, and voters across Colorado. You cannot claim moral authority on immigrant protections while simultaneously undermining them.
